Dispatching Japanese Workers in Italy

In this article, we want to take into consideration the cases provided for by the Italian immigration law (Legislative Decree 286/98) which allow you to dispatch a Japanese worker to an Italian company.

Before this, it may be interesting to give an overview of the phases in which the obtaining of a residence permit in Italy is articulated.

The first step is the request for a work permit (Nulla Osta): it is requested through an online application on the website of the Ministry of Internal Affair. The request must be made by the Italian company, and it is also possible to proceed with it by delegated attorneys like us on behalf of them. The type of application depends on which procedure you need to choose. Before sending the application it is important to check which documents need to be prepared for the type of procedure chosen.

Following the submission of the application, after approximately 3/4 weeks, a communication is received from the Immigration Office which gives you an appointment for the delivery of the documents, and if the documents are correct, for the issue of Nulla Osta on the same day. The Nulla Osta will be sent automatically to the Italian Embassy in Tokyo or to the Italian Consulate in Osaka.

The second step is the visa application: it must be done by the Japanese worker at the competent Embassy or Consulate in Japan, making an appointment online from the website of the Italian embassy. On that website, there is also the application of the visa to be filled and the list of documents to be brought. On the day of the application appointment, documents and passport must be submitted. It usually takes two to three weeks to get the requested visa.

The third step is the request for the permit to stay (permesso di soggiorno): when the worker enters in Italy with his appropriate visa, within 8 days he/she needs to go to the Immigration Office which issued the Nulla Osta to sign the contract of stay (contratto di soggiorno) and the integration agreement and must go to a post office to send the application for the residence permit. The post office issues a receipt indicating the date on which the worker has to go to the Police station for the identification (fingerprints).

About 2 months after the permit to stay will be ready and it can be picked up at the Questura. The validity of the permit is 2 years with the possibility of renewal.

After this brief overview let's see what are the immigration cases that concern this article:

We are talking about the particular cases of subordinate work indicated in art. 27 letters (a) and (i), and articles 27quater and quinquies of Legislative Decree 286/98 (Immigration Act).

- art. 27 letter (a): dispatch of managers or highly specialized workers

- art. 27 letter (i): dispatch of workers within a procurement contract

- art. 27 quater: dispatch of highly qualified workers (called EU Blue Card)

- art. 27 quinquies: intra-company dispatch of managers or skilled workers (called ICT)

It is important to highlight that all the cases listed above are outside the numerical quotas set each year by Italy for the entry of foreign workers and therefore the visa can never be refused for an excess of the quotas.

Another important element to highlight is in which of these cases there must be a link between the company based in Japan and the company based in Italy. Of these cases, those provided by articles 27 letters (i) and 27quater do not require a connection between two companies, while for the other two cases mentioned there must always be a link between the Japanese company and the Italian company and the dispatching is also permitted from the Japanese company to a representative office based in Italy. The most frequently requested case is that the Japanese company owns/ sets up the Italian company, or the representative office, and sends its own manager to manage the Italian branch.

It is also important to mention the possibility of bringing the family such as wife and children to Italy by choosing one of the three possible methods; family reunification visa, accompanying family member visa, or family cohesion. The family cohesion case means that the family enters together or after the worker as a normal tourist, then they request a permit to stay directly in Italy.

When planning an investment in Italy, such as the opening of a company, it is also important to consider whether the project includes the sending of employees in Italy as this affects the planning of the structure of the company.

Promoting Italian companies with ACCI Gusto

There is an air of satisfaction among the booths of the Veneto region hosted in the ICCJ’s exhibition area. "ACCI Gusto is an oasis for food product makers of Italy. Visitors already know the quality of the products and are aware of the importance of its provenance,” commented Antonella Riva, head of Promozione Veneto. “Companies going to Japan for the first time have the double opportunity of B2B meetings but also to inspect the Japanese market without intermediaries. In this way they directly mature awareness of what it means to export to Japan, as meeting the buyers in Italy is not enough,” she added.

The “ACCI Gusto” trade fair took place on the 17th and 18th of November, providing a unique opportunity for companies that want to launch their products for the first time to the Japanese market and for those who are already present in the market and looking for new distribution channels. ACCI Gusto is the first trade fair specialised in promoting the Italian food industry in Japan and counts about 4000 visitors every year. It is a distinctive meeting platform for the major importers, distributors, organised by the Association of Chefs of Italian Cuisine.

The ICCJ participated for the third year in a row by offering support to 10 companies, most of which were visiting Japan for the first time. These companies (mostly SME’s, family-owned producers of Veneto) offered traditional high-quality food, with authentic, natural ingredients and genuine production methods. They had the opportunity to understand the local market and meet potential partners for export to Japan, thanks to regional funds and the coordination of Promozione Veneto, as well as the ICCJ.

The other companies who participated in ACCI Gusto and supported by ICCJ were logistical services supplier (Schenker-Seino Co., Ltd.)  and 2 olive oil producers from Tuscany and Marche (Bellanducci and Massimo Mosconi, 3rd place at the Olive Oil Prize, 2015 edition).

ICCJ’s aim in participating to this trade fair is not only to support Italian producers interested in finding Japanese business partners, but also to spread and deepen the knowledge of Italian food products in Japan through seminars and workshops. ICCJ also offers support to Japanese companies involved in the business of importing Italian products to Japan.

Italian Innovation Day 2019 – Public Bid for Sponsorship

The 2019 edition of the Italian Innovation Day (IID), organized by the Italian Embassy in Tokyo in collaboration with Italian and Japanese public institutions (ICE, Invitalia, Japan External Trade Organization JETRO), will be held on 9 October 2019 at the JETRO headquarters (Ark Mori Building, Tokyo).

Fifteen Italian startups and scaleups will have the opportunity to present themselves in front of a vast public of important companies and local investors in search of innovative products, technologies and services. 

The initiative will be promoted and enhanced through marketing and communication actions coordinated by this Embassy and addressed to the largest Japanese companies engaged in technological innovation, specialized media (with a focus on bloggers, online newspapers and radio) and communities of entrepreneurs and creatives revolving around the main hubs of the local innovation ecosystem. Working in Italy: sending Japanese workers to Italy without creating a company first

In this case of business between Japan and Italy, we face a situation in which a Japanese company intends to send its own employee to a complete independent Italian company which is his exclusive distributor for Italian and European markets.
What kind of visa and residence permits can be activate and under what conditions? Not
always, in fact, it is necessary to open a company to work in Italy but there are other ways, such as the one we have dealt with the last time which was referred to opening a representative office in Milan.
Can the Japanese company get a visa and residence permit for its employee?
Of course yes. In order to enter Italy there are special visa cases including the one provided by “Article 27 quarter” of the Italian Immigration Law, for highly skilled Japanese workers.This visa is also called “Blue Card”.
This type of visa is given to the Japanese worker who has the following requirements:
- The Japanese worker must be highly qualified in terms of education;
- the Japanese worker must agree to carry out his work as an employee of the Italian company
What are the requirements of this visa in detail?
The Japanese worker must be in possession of a higher education qualification, of the duration of at least 3 years, issued by the Japanese competent authority (Japanese Ministry of Education).
The Italian Ministry of Internal Affair has accurately indicated which workers are within the "highly qualified" category, and it is therefore possible to check if your position is listed by the Italian Ministry.
What are the features of this visa?
This type of visa is among those outside the quota. This means that obtaining the visa does not depend on the annual quota set by the Italian Government for the entry of foreign workers into Italy.
It has a faster administrative procedure than the generic visa for subordinate work. It will be necessary to prepare the right documents to get the “nulla osta” from the Italian Immigration Office, which is the first step to obtain the visa and subsequently the residence permit.
Can the Japanese worker's family come to Italy?
Yes. The worker will be able to apply for a visa for family reunion. It will be important to choose a suitable apartment to accommodate all the members of the family already in the process of the vista for the worker in order to not waste time to find another flat after.
Once the Japanese worker enter Italy, what are the fulfilment that has to be done?
Within 48 hours of entering Italy the Japanese worker must go to the Questura together with the house owner for the "hospitality statement".
Subsequently, the employee will be called by the Immigration Office to sign the immigration agreement and the application for a residence permit. Then he will have to go to a post office to send the application for a residence permit to the Questura and receive at the same time the appointment at the Questura for the issuance of the residence permit.
In the following days you will have to do your residence registry and sign up for the National Health Service, make the Italian ID card, and if you need to convert the driving license and open a counter-current in an Italian bank.

ACCI Gusto and the Italian agro-food sector in Japan

When a Japanese person thinks of Italy, the first thing that usually comes to mind is Italian food.
When they think of Italian food, it is often of pasta, risotto, gnocchi, pizza, fresh tomatoes, basil, oregano, mozzarella cheese and of course the famous tiramisu dessert.

In recent years, Japanese people have started associating olive oil and coffee with Italy as well. In Japanese supermarkets, various types of imported Italian olive oil and coffee can be found. Lately, a lot of Italian mineral water is being imported into Japan as well.

"Itameshi" or "Italian food" has been topping the popularity charts in Japan for decades. Spaghetti has been on the menus of cafes in Japan since the 1920s. Italian pasta sauce was popularized first by Italian-Americans during the occupation, but a wider acquaintance with Italian food had to wait until the 1990s when there was a decrease in the consumption of French food which subsequently meant a rise in Italian cuisine. Italian food was seen as "friendly, cheap, and cheerful" compared to the hauteur and formality of French food.

There are now countless numbers of Italian restaurants in Japan (especially in Tokyo) that are very authentic. There are numerous Italian chefs but also a growing number of Japanese chefs who study in Italy and return after several years to bring these Italian regional flavors back to Japan. All in all, Italian food is very popular all over Japan.
But it is not just about the food.

In recent years, wine, coffee, and other Italian beverages have become popular in Japan.

The Japanese are becoming great connoisseurs of Italian wine and coffee - for example, there has been a boost in the number of wine stores, wine bars, wine events and wine-dedicated sections in shopping centers.
Various articles and studies predict there will be an increase in the Italian food market in Japan and a number of Japanese companies are keen to increase this business and import new Italian ingredients.
